Part of the Ministry of Economic Development's strategic direction is ensuring that New Zealand's financial and commercial institutions are effectively monitored and that business regulations are enforced. This in turn promotes accountability and responsibility in business practice and helps with protecting New Zealand's commercial community.
The National Enforcement Unit (NEU) investigates and, where appropriate, prosecutes offences under various legislation on behalf of the Official Assignee, the Registrar of Companies and the Registrar of Motor Vehicle Traders.
The NEU also prepares banned director reports on behalf of the Registrar of Companies.
The National Enforcement Unit (NEU) was formed on 21 June 1999. The unit operates nationally and is based in Auckland.
The creation of the NEU significantly increased compliance and confidence within the commercial community due to the Unit’s ability to deal with serious offences against relevant legislation.
The unit's goal has always been to have robust and effective enforcement of the relevant legislation. A significant impact has been made on existing unlawful activities of bankrupts, unlawful motor vehicle traders and delinquent directors amongst others to ensure that they are being held accountable for their actions.
In addition to the investigation and prosecution of offenders, the NEU is responsible for the assessment of candidates for prohibition under section 385 of the Companies Act 1993.
The successes of the unit since its formation can be put down to a number of factors, most noticeably the dedication and specialist skills of the staff who all have a range of skills spanning across past police and law enforcement backgrounds to experience in the banking and commercial industry.
