Withdraw an existing objection

 

Where notice is given that a company is to be removed from the Register (deregistered) a person may object on one or more of the grounds listed under section 321 of the Companies Act 1993. 

Anyone can object to the removal of a company from the New Zealand Register of Companies as long as it is no later than the date specified in the public notice. 

 


Withdraw your objection online

If you have objected to a company’s removal using our online objection service, and now wish to withdraw that objection, you can use our FREE online ‘Withdraw an existing objection’ service.

To do this you must be logged on to the Companies Office website as a registered user.  The objection can only be withdrawn by the individual who made the original objection, or if the objection was made by an organisation, a member of the same organisation.

 

Step one | locate the existing objection

From the Online Services – Do It Now menu choose Withdraw an existing objection.

All existing objections you have made will now be displayed on the screen, select the Withdraw button to permanently withdraw your objection to the companies removal.


Step two | provide a reason

In the box that appears enter the reason why you want to withdraw your objection to the company’s removal and select the Browse... button to upload any supporting documentation if required.

Select the Withdraw objection button to submit your request.

The withdrawal of your objection is accepted automatically and you will now be returned to your dashboard.  Next to the objection in your My Unfinished Business section you should now see that the status is listed as withdrawn.

Withdraw your objection in writing

If you objected to the removal of a company in writing and now wish to withdraw the objection, you will need to request the withdrawal in writing also.  You will need to:

  1. Submit in writing your request to withdraw the objection including the reason for the withdrawal and enclose copies of any supporting evidence if required.
  2. Send your request to withdraw the objection via email to compliance@companies.govt.nz or by post to the following address:

Your request to withdraw an objection will be processed within five working days.  You will be sent a response in writing either confirming withdrawal of the objection, or, if your request is rejected, explaining the reasons for that rejection.
